Caldera Tours is a concierge services website aimingto assist Santorini visitors to research and book travel experiences; however,we do not provide such experiences ourselves. When you make a booking, you willbe purchasing a tour, ticket, or other service directly from a third-partysupplier.

By opening or employing Caldera Tours services,you are implying that you have read these Terms of Use and agree. If you do notagree with all these Terms of Use, you are not permitted to access or use theservices. We may update or otherwise modify these Terms of Use at any time,without prior notice.

Company’s trademarks and trade suitmay not be used, including as part of trademarks and/or as part of domainnames, in connection with any product or service in any manner that is likelyto cause confusion and may not be copied, imitated, or used, in whole or inpart, without the prior written permission of the Company.

Reference to any products,services, processes or other information, by trade name, trademark,manufacturer, supplier or otherwise does not constitute or imply endorsement,sponsorship or recommendation thereof by Caldera Tours.

Products and BookingReservations

1. Caldera Tours provides the Website through which you canenter into agreement with a third-party supplier of a Service/Package. CalderaTours is not a supplier of any Product, and your contract for supply of anyProduct you Book will be directly between you and the applicable Supplier. In respectof each Booking, Caldera Tours acts as an agent for the Supplier, meaning thatwe are free to accept or reject offers on behalf of that Supplier. Theprovision of the Product you Book will be subject to the terms and conditionsdisplayed on the Website in respect of such Product, any information madeavailable to you during the Booking process, and the terms and conditions ofthe Supplier with whom you have a legal contract for the supply of the Product.

2 If you make a Booking, you agree to review and be bound by theapplicable Supplier's terms and conditions and any other rules or policiesrelated to the Service. Notwithstanding the foregoing, to the extent that theSupplier Terms conflict with these Terms of Use in respect of your legalrelationship with Caldera Tours, these Terms of Use shall prevail. Yourinteractions with Suppliers are at your own risk. Caldera Tours will have noliability with respect to the acts, omissions, errors, representations,warranties, breaches, or negligence of any Supplier or for any personalinjuries, death, property damage, or other damages or expenses resulting fromyour interactions with any Supplier.

3. Caldera Tours provides the Website with information aboutProducts and facilitates Bookings, such actions do not in any way constituteany affiliation between Caldera Tours and any Supplier. You agree that CalderaTours is not responsible for the accuracy or completeness of information itobtains from Suppliers and/or that is displayed on the Website.

4 By making a Booking, you warrant that you are at least 18years of age, that you possess the legal authority to enter into both thisbinding agreement and a binding agreement with the Supplier, to use theServices, to purchase the Product, and that all information you supply is trueand accurate. You further agree that you will use the Website to make onlylegitimate Bookings for you and/or others for whom you are legally authorizedto act.

5. All accommodation reservationsare processed in partnership with Booking.com and through their platform. To viewor modify your booking you need to log in to the partner’s website that handleyour reservation.

Payments

The payments on our website are processedthrough ALPHA BANK E-commerce following the PCI DSS security standards and TLSprotocols. Full payment by credit or debit card is required to make a Booking,unless otherwise specified. 

Your bank or payment card company may convertthe payment into the local currency and may charge fees, resulting indifferences between the amount displayed on the website and the final amountcharged to your CC. In such event, please contact your bank or cardcompany.

Reservations Amendmentsand Cancellations

i)             Cancellation/Amendment by You

A reservation cannot be changed by you orcancelled with a refund, unless otherwise stated in the terms and conditionsapplicable to such Product.

You must always check the cancellation policy contained inthe Product listing description, which is the policy that will regulate theterms of your amendment /cancellation and refund.

We do not guarantee the success of any ReservationAmendment Request. In case the Supplier is reluctant or incapable to acceptsuch Amendment Request, then your booking shall be governed by the cancellationterms containedin the Product listing description.

ii)            Cancellation by Supplier

If weather conditions, official measures,strikes or other unforeseeable or unavoidable external conditions (in particularforce majeure) make the execution of the activity impossible, considerably moredifficult or endanger it concluding to a cancellation by the supplier. In thiscase the paid price is refunded unless otherwise stated by Greek legislation.

All Sailing activities require specificpersonal data of yours, which are obligatory for your participation by GreekPort Authorities regulations. Failure to deliver you information on time (atleast 14 hours prior to the activity starting time) will result to a nonrefundablecancellation by the supplier.

Third party websites andcontent

The Sitecontains (or you may be sent through the Site or the Service) links to otherweb sites (“Third Party Sites”) as well as articles, photographs, text,graphics, pictures, designs, music, sound, video, information, applications,software and other content or items belonging to or originating from thirdparties (the “Third Party Applications, Software or Content”). Such Third PartySites and Third Party Applications, Software or Content are not investi-gated,monitored or checked for accuracy, appropriateness, or completeness by us, andwe are not responsible for any Third Party Sites accessed through the Site orany Third Party Applications, Software or Content posted on, available throughor installed from the Site, including the content, accuracy, offensiveness,opinions, reliability, privacy practices or other policies of or contained inthe Third Party Sites or the Third Party Applications, Software or Content.Inclusion of, linking to or permitting the use or installation of any ThirdParty Site or any Third Party Applications, Software or Content does not implyapproval or endorsement thereof by us. If you decide to leave the Site andaccess the Third Party Sites or to use or install any Third Party Applications,Software or Content, you do so at your own risk and you should be aware thatour terms and policies no longer govern. You should review the applicable termsand policies, including privacy and data gathering practices, of any site towhich you navigate from the Site or relating to any applications you use orinstall from the site.

Our Liability

i)                   Caldera Tours disclaim all liability for, anyerrors or other inaccuracies relating to the information and description of theproducts and other services (including, without limitation, the pricing, availability,photographs, features, inclusions and exclusions, general product descriptions,reviews and ratings, etc.). in addition, we expressly reserves the right tocorrect any availability and pricing errors and/or on bookings made under anincorrect price.

iii)          Thesuppliers are independent contractors and not employees of caldera tours,therefor we are not liable for the acts, errors, omissions, representations,warranties, breaches, negligence or misconduct of any such suppliers or for anypersonal injury, death, property damage, or other damages or expenses resultingtherefrom or otherwise arising from any booking or use of a product. calderatours have no liability and will make no refund in the event of any delay,cancellation, overbooking, strike, force majeure or other causes beyond theirdirect control, and they have no responsibility for any additional expense,omissions, delays, re-routing or acts of any government or authority.

iv)          If anyCaldera Tours is found liable for any loss or damage that arises out of or isin any way connected with your use of the Services or with a Booking or use ofa Product, then the Caldera Tours liabilities will in no event exceed, in theaggregate, the greater of the sum paid to us in respect of the Booking givingrise to the claim.

Your Liability

Youagree to defend and indemnify all of the respective officers, directors,employees and agents of Caldera Tours, from and against any claims, causes ofaction, demands, suits, proceedings, investigations, losses, damages, fines,penalties, fees, expenses, costs and any other liabilities of any kind ornature including but not limited to reasonable legal and accounting fees,arising out of or related to: a. your breach of these Terms of Use or thedocuments referenced herein; b. your violation of any law, rule, regulation orguideline; c. your violation, infringement or misappropriation of the rights ofa third party, including without limitation any rights of publicity or privacy;d. your use of the Services (including the Website); e. your Booking or use ofany Product; or f. your negligence or willful misconduct.

Govenrning Law

Thisagreement and its performance shall be governed by the laws of Greece, withoutregard to its conflicts of law provisions. You consent and submit to the jurisdictionof the state and federal courts located in Greece, in all questions andcontroversies arising out of this agreement and your use of the site.

PERSONAL DATA

Data We Collect

Online reservation procedure

Guests of third party websites are asked to give personal data in order to complete their online reservations. The data they are asked to give are upon the administrator – controller of the system.

Data given automatically

There are many instances that we get data automatically. Such data are: IP address, type of device, location, date and time of accessing our system, pages that are visited and clicked, from which website someone came to our system, browser that is used, software that is used in the device or computer.

Data given from other sources

Our booking engines are integrated with other websites (online wholesalers, Online Travel Agents, etc) who are giving data about completed reservations. The data are used from controllers (administrators) for managing purposes.

Data we share with others

We share the above personal data with third party systems for basic purposes of completing an online reservation. For example, we use a third party mail provider for security reasons (to avoid emails going to spam). Our systems are cloud and we use hosting services of Amazon.com (https://aws.amazon.com/security/) . In addition in some instances we share data with third party systems for managing or accounting purposes of the controller (administrator). Also we share data with banks and online payment gateways for successful secure transactions.
